NYBC Volunteer Release
and Waiver of Liability

This Volunteer Release and Waiver of Liability (this “Release”) is entered into by the undersigned individual (“I” or “me”) in favor of National Youth Bike Council, a not-for-profit corporation organized and existing under the laws of the Commonwealth of Pennsylvania, and its directors, officers, employees, volunteers, and agents (collectively, the “Organization”).

I desire to provide volunteer services to the Organization and to participate in activities related to serving as a volunteer (the “Activities”). I understand that the Activities may include, but are not limited to, volunteer and program-related services in support of the Organization’s mission. I further understand that I will receive no compensation or remuneration for my services and will not be eligible for any employee benefits. I acknowledge that I am not an employee of the Organization.

In consideration of being permitted to participate in the Activities, and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, I freely and voluntarily agree to the following terms:

Assumption of Risk

I understand that participation in the Activities may involve inherent risks, including both foreseeable and unforeseeable hazards. I knowingly and voluntarily assume all risks of injury, harm, loss, or damage that may result from my participation in the Activities.

Medical Treatment

I authorize the Organization to obtain medical treatment on my behalf in the event of injury or medical emergency during my participation in the Activities. I understand that I am solely responsible for all costs associated with such medical treatment, transportation, or evacuation. I release and hold harmless the Organization from any claims related to such medical services.

Release and Waiver

I hereby fully and forever release, waive, and discharge the Organization from any and all claims, liabilities, demands, or causes of action of any kind, whether in law or equity, arising out of or related to my participation in the Activities. This includes, but is not limited to, claims for bodily injury, personal injury, illness, death, property damage, or property loss, whether caused by the negligence of the Organization or otherwise.

Insurance

I understand that the Organization does not provide medical, health, disability, or workers’ compensation insurance for volunteers and assumes no responsibility for any costs arising from injury, illness, death, or property loss. I expressly waive any claim for compensation or liability against the Organization related to such matters.

Photographic Release

I understand that I may be photographed or recorded during the Activities. I grant the Organization the right to use my name, image, likeness, and voice in photographs or recordings for internal, promotional, or publicity purposes, in any medium and in perpetuity, without further compensation or approval.

Miscellaneous

This Release represents the complete and final agreement between the Organization and me regarding the subject matter herein and supersedes all prior agreements or understandings. If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Release is binding upon me and my heirs, legal representatives, and assigns.

Governing Law

This Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania.

Acknowledgment

It is a requirement of participation and membership that all individuals 18 years of age or older read and agree to this Release. Individuals under the age of 18 must review and agree to this Release with a parent or legal guardian.

By participating in National Youth Bike Council programs or events, participants acknowledge that they have read, understood, and agreed to the terms of this Release.
